You’ve heard the saying before, “Know your rights.” But how can you be certain what rights and laws you have as a surrogate mother and/or as the intended parents, when there is not one overarching law on the issue? In the case of surrogacy, each state has its own laws and knowing your rights takes research.
For example, in California, the courts have been favorable in upholding and extending the California Family Law statues to protect all parties to surrogacy pregnancies. In Florida, surrogacy is also permitted; however, specific provisions must be included in the contract for it to be legally binding and enforceable.
