If a kid is delivered through surrogate pregnancy and his dad has a gay partner, the latter may be his legal father too. So ruled last week theBundesgerichtshof (German Federal Court of Justice), assessing an issueo which was brought up before the judges by a Berlin’s gay couple. In 2010 they went to California in order to conceive a baby though surrogacy, a procedure forbidden in Germany. In 2011, the California Superior Court declared that both men were legal parents of the child, after the natural father had acknowledged paternity at the German consulate. Upon returning home, the child wasn’t recognized by the German authorities as the couple’s. The Court has eventually ruled that the decisions of foreign authorities in such matters must be respected as “part of a child’s welfare to be able to rely on the parents to have continuous responsibility for its well-being”.
